These Terms of Service explain the rules for using EngineFleet. By creating an account or using the site, you agree to them. Please read them carefully, especially sections 7, 8, 13 and 14, which explain what you are responsible for and the limits on our responsibility.
1. What EngineFleet is
EngineFleet is an online service that lets businesses take bookings through their own booking page, manage their calendar, vehicles, customers, deposits and payments, send contracts for e-signature, and give each customer a private booking link.
EngineFleet is not a marketplace, a bank, an e-wallet or a payment processor. Bookings are made directly between a business and its customers, and customers pay the business directly, for example through the business's own GCash, Maya or bank account, or an online checkout connected to the business's own payment account. We are not a party to those bookings, we never hold or move the money for them, and we cannot confirm or reverse those payments.
EngineFleet is owned and operated by Cloudlabs Software Development Services (DTI Business Name No. 8561842), Guiguinto, Bulacan, Philippines. "We", "us" and "our" in these terms mean Cloudlabs.
2. Who can use EngineFleet
You must be at least 18 years old to create a business account, or have the permission of a parent or guardian who agrees to these terms for you.
Customers can use a business's booking page and their booking link without an account.
3. Your account and your team
You sign in with your Google account or with a one-time code sent to your email. You are responsible for keeping that account secure and for everything that happens under your EngineFleet account.
If you add staff to your business, you decide what they can do, and you are responsible for their actions in EngineFleet, such as accepting bookings, recording payments or changing prices, as if you had done them yourself. Remove staff who should no longer have access.
Please give accurate information about yourself and your business, and keep it up to date.
4. Your booking page and content
You own the photos, vehicle descriptions, business name, contract text and other content you add. You give us permission to host, display, resize and share that content so we can run your booking page, send your emails and contracts, and create link previews and calendar links.
You confirm that you have the right to use everything you upload, and that your vehicles, prices, availability and policies are accurate.
5. What you can't do
Do not use EngineFleet to offer anything illegal, unsafe or that you are not licensed to provide; to mislead customers about prices, inclusions, dates or availability; to take deposits for bookings you don't intend to honour, or for any scam; or to post hateful, violent, sexual or harassing content.
Do not try to break into, overload or disrupt EngineFleet, get around plan limits, copy other businesses' data, or use automated tools to collect information from the site.
We may hide or remove content, or suspend accounts, that break these rules.
6. Bookings between businesses and customers
Businesses set their own prices, deposits, availability, cancellation and refund policies, and contract terms. Any booking, and any contract signed through EngineFleet, is between the business and the customer.
If something goes wrong with a booking, the business and the customer should work it out together. We may help where we can, but we are not responsible for the services provided, payments, refunds, cancellations, no-shows or disputes between businesses and customers.
7. Payment checks are hints, not proof
To save you time, EngineFleet reads details such as the reference number and amount from payment screenshots customers send, and warns you about things that look wrong. These checks are read automatically from an image and can be wrong. A screenshot can be edited or faked in ways no check can detect.
A screenshot, our checks, or the absence of a warning do not prove that you were paid. Before you confirm a booking or record a payment, always check it in your own GCash, Maya or bank account. You decide whether to accept each payment, and you are responsible for that decision.
We are not responsible for losses from fake, edited or reused screenshots, payments that were never received or were reversed, or mistakes in what was read from a screenshot.
8. Customer information you collect
When you add a booking or a customer books through your booking page, you collect the customer's personal information, such as their name, email, phone number, booking details, payment screenshots, signed contracts and any documents you ask for, such as a valid ID or driver's license. For that information, you are the personal information controller under the Data Privacy Act of 2012, and EngineFleet stores and processes it on your behalf to run the service.
A renter may also choose to create an optional EngineFleet renter account to save contact details and link bookings they can access. That account is separate from your customer records; it does not merge them or give you access to the renter's bookings with other businesses. Booking without an account and private booking links continue to work.
Only ask for what you need for the booking, only use it to handle that customer's bookings, keep it confidential, and don't share it except as needed to provide the service. Delete documents you no longer need. Our Privacy Policy explains how we store this information.
9. Plans and payment
There is no free trial and no free plan: a new business account chooses and pays for a plan before it can take bookings. Plans differ in how many cars you can have active, and Engine RS and Engine GT also include your booking page on your own domain. The plans and their prices are shown on our Pricing page. Paid plans have no monthly booking limit, subject to fair use. Without a paid plan running, your account is locked: you can still sign in and see your information, and bookings already confirmed can go ahead, but you can't take new bookings or add or turn on cars, your booking page doesn't take bookings, and a custom domain sends visitors to your free booking link (as it does on Engine Solo and Engine R, which don't include one).
Plans are paid in advance for each period and never renew automatically. When a paid period ends without a new payment, your account is locked until you pay again. Your bookings and content are not deleted, unless nobody uses the account for 6 months (see Closing your account).
Plan payments are handled by our payment providers, or sent by Wise transfer and confirmed by us once received, and made to Cloudlabs Software Development Services. A plan paid by Wise starts when we confirm the transfer. Except where the law requires otherwise, payments for a period that has already started are not refundable.
We may change our plans, prices or limits. If a change affects what you pay or what your plan includes, we will tell you before your next payment.
10. Keeping the service running
We work to keep EngineFleet available and secure, but we can't promise it will always be available, error-free, or that no data will ever be lost. Emails, reminders and notifications depend on email and push services we don't control and may arrive late or not at all. We may add, change or remove features over time.
Keep your own records of important bookings, payments and contracts. You can download signed contracts, receipts, payment screenshots and files.
11. Closing your account
You can stop using EngineFleet and delete your account at any time, from Settings › Business › Delete business or by contacting us. Your booking page goes offline right away, and everything is deleted 30 days later. Until then you can sign in and keep your account, and everything comes back as it was.
If your account has no plan running and nobody has used it for 6 months, we delete it the same way: we email you, your booking page goes offline, and you have 30 days to sign in and keep it. Customers' documents and payment screenshots are deleted 3 months after each rental ends, as our Privacy Policy explains. We tell you a week before, so you can download any you need to keep.
A renter can remove saved renter details and linked booking references from My bookings. This does not delete the business's booking records; private booking links continue to work.
We may suspend or close accounts that break these terms, put customers or other users at risk, or are used for fraud. Where reasonable, we will tell you why first. While an account is suspended, its booking page is offline, and its data is kept unless you ask us to delete it.
12. Our name and brand
The EngineFleet name, logo and site design belong to us. Please don't use them in a way that suggests we endorse you without our written permission.
13. Limits on our responsibility
EngineFleet is provided as is and as available. To the extent the law allows, we are not liable for indirect or consequential losses, lost bookings or lost profits, double bookings, for losses from payments you accepted or services you provided, or for problems caused by businesses, customers, staff, or third-party services such as Google, Apple, Microsoft, GCash, Maya, banks or payment providers.
To the extent the law allows, our total liability to you for any claim about EngineFleet is limited to the amount you paid us for your plan in the 12 months before the claim.
Nothing in these terms limits liability that cannot be limited under Philippine law, such as for fraud or gross negligence, or rights you have under Philippine consumer protection law that cannot be waived.
14. Your responsibility to us
You agree to cover our losses and reasonable costs, including legal fees, from claims by customers or anyone else that arise from your services, your bookings, your content, your contracts, how you handle customers' personal information, or your breaking these terms or the law.
15. Governing law and disputes
These terms are governed by the laws of the Republic of the Philippines. If you have a problem with EngineFleet, please contact us first so we can try to resolve it together before going to any authority or court.
16. Changes to these terms
We may update these terms from time to time. We will post the new version here with a new effective date, and tell account holders about important changes. If you keep using EngineFleet after a change takes effect, you agree to the new terms.
17. General
If any part of these terms is found invalid, the rest still applies. If we don't enforce a part of these terms right away, we can still enforce it later. These terms, our Privacy Policy and the plan details on our Pricing page are the whole agreement between you and us about EngineFleet.
